What it is
Owners report décor and exterior lighting that has been in place for years suddenly being cited, and rules being “interpreted” by individuals rather than applied from the written documents. The new fine schedule adds a 45/60-day holiday décor window.
Why it matters
Rules enforced against some owners and not others are the classic HOA dispute - and the statute is explicit that enforcement must be uniform.
What the rules say
- NRS 116.31031 - fines may only be imposed under rules that are applied uniformly.
- Design Guidelines §3.15 covers exterior lighting. Read what it actually says before assuming a citation is valid.
- NRS 116.31065 - a rule has to be explicit enough that an owner can know what is prohibited.
What you can do
- If cited, ask for the specific section of the CC&Rs, Rules, or Design Guidelines being enforced, and whether the same rule has been enforced against other lots.
